All non-McKenzie River Trust employees must sign a waiver of liability before participating in activities associated with McKenzie River Trust.
This Release and Waiver of Liability executed by “Volunteer” releases McKenzie River Trust, a nonprofit corporation organized and existing under the laws of Oregon and each of its directors, officers, employees, and agents. I desire to provide volunteer services for McKenzie River Trust and engage in activities related to serving as a volunteer.
I understand the scope of my relationship with McKenzie River Trust is limited to a volunteer position and that no compensation is expected in return for services provided by me; that McKenzie River Trust will not provide any benefits traditionally associated with employment and that I am responsible for my own insurance coverage in the event of personal injury or illness as a result of my services to McKenzie River Trust.
1. Waiver and Release. I hereby agree for myself and my child and for my heirs, relatives, representatives, estate, agents and assigns, that I will not hold liable McKenzie River Trust, or any of the persons listed in Paragraph 3 below, and that I will waive and release any claims, demands or actions against them, for any damages to, or loss of, my property or my child’s property, or for my, or my child’s, injury or death, which results from or arises in connection with any of the activities of McKenzie River Trust, other than that which results from gross negligence. I understand that this waiver includes a waiver of liability for acts of negligence. In addition, I agree to indemnify the organization and the persons listed below for any claims made against them, on my behalf, on my child’s behalf, or otherwise, as a result of any damage to, or loss of, my property, or my child’s property, or as a result of my injury or death, or my child’s injury or death, resulting from or arising in connection with the activities of McKenzie River Trust, other than that which occurs as a result of the gross negligence of McKenzie River Trust or the persons listed below.
2. Assumption of Risk. I and/or my child am freely volunteering to participate in the activities offered by McKenzie River Trust and I understand that there could be dangers involved in the activities I or my child will be participating in, including, but not limited to: dangers associated with travel, sharp objects, exposure to illness, etc. I understand that I am entirely responsible for deciding whether I and/or my child participate in any activities with McKenzie River Trust, and for deciding what activities in which I/we can safely participate.
3. Persons Covered. The persons and organizations covered by this agreement include: McKenzie River Trust and its directors, officers, members, staff, employees, volunteers, agents and representatives, and any others who participate in the activities of McKenzie River Trust, or who volunteer for, or perform work for, McKenzie River Trust.
Optional Photographic Release. I grant and convey to McKenzie River Trust all right, title, interests in any and all photographs, images, video, or audio recordings of me, or my child, or my likeness or my child’s likeness or voice made by McKenzie River Trust in connection with my participation with McKenzie River Trust.
